A. Specified: In addition to any other powers provided by state law or the provisions of this code, the city manager is authorized and empowered during a declared local emergency to exercise, with the assistance of the emergency program manager and in consultation with the city attorney, all emergency powers, including, but not limited to, all of the following:
1. Issue such orders as are imminently necessary for the protection of life and property, including those authorized in Utah Code Annotated title 63K, or any successor provisions;
2. Utilize all available resources of the city as reasonably necessary to manage the local emergency;
3. Suspend the city compensation policy or rules regarding overtime, payroll budget restrictions, compensation time accrual and personnel/sick time use restrictions, allowing department directors to utilize personnel as necessary to answer the challenges of the emergency presented to each department. Notwithstanding the foregoing, the city shall adhere to all state and federal labor laws;
4. Direct emergency response activities by city departments including, but not limited to, the police and fire departments, and by such emergency services personnel as the city manager may designate or appoint;
5. Execute contracts for the emergency construction or repair of public improvements, when the delay of advertising and public bidding might cause serious loss or injury to the city, pursuant to the procedures in section 6-1B-7 of this article;
6. Purchase or lease goods and services that the city manager deems necessary to the city's emergency response or for the repair of city facilities, or both, pursuant to the procedures in section 6-1B-7 of this article;
7. Lease real property or structures, or both, that the city manager deems necessary for the continued operation of city government;
8. Promulgate rules and orders to implement and clarify the city managerial proclamation exercising emergency power;
9. Invoke the provisions of any mutual aid or interlocal agreements entered into by the city;
10. Request assistance from political subdivisions participating in the statewide mutual aid system, pursuant to Utah Code Annotated section 53-2-401 et seq., or any successor provisions;
11. If reasonably necessary to cope with a local emergency, adopt a curfew upon all or any portion of the city, thereby requiring all persons designated curfew areas to forthwith remove themselves from the public streets, alleys, parks or other public places during the specified times; the city manager reserves the right to designate specific professionals be exempted from such a curfew, including, but not limited to, physicians, nurses and utility personnel;
12. Suspend or limit the sale, dispensing or transportation of alcoholic beverages, explosives and combustibles in relation to an evacuation;
13. Close all private clubs or a portion thereof where the consumption of intoxicating liquor and/or beer is permitted;
14. Discontinue the sale of beer or other alcoholic beverages;
15. Designate any public street, thoroughfare, alley, park or vehicle parking areas closed to motor and pedestrian traffic;
16. Control ingress and egress to and from any part of the city, including controlling the movement of persons within an emergency or disaster area and ordering the occupancy or evacuation of premises in such area; and
17. Delegate any or all of these duties to the assistant city manager.
B. Immediate Effect; Public Notice: All proclamations, orders, rules, and regulations promulgated by the city manager, not in conflict with existing laws, shall become effective immediately upon execution. The city shall use its best effort to file a copy of any such proclamations, orders, rules, and regulations with the city clerk/recorder as soon as reasonably practicable. Public notice of such filings shall be given by the best practicable means available under the circumstances existing at the time. (2009 Code)
